Submission on the Criminal Procedure Amendment Bill B39-2010

On 24 August, CSPRI researcher, Clare Ballard, presented a submission to the Portfolio Committee for Justice and Constitutional Development on the proposed amendments to the ‘use of deadly force’ provisions in the Criminal Procedure Act 51 of 1977.

The thrust of the submission was that although, as a general proposition, the use of deadly force will, in certain prescribed circumstances, be necessary during the carrying out of an arrest, the amendment bill altered the standard of protection required by the Constitution and which is currently reflected in the text of the Criminal Procedure Act.
